<br />DRAFT <br /> <br />Colorado Water Conservation Board Action: <br />At its November 2005 regular meeting the Board reviewed the AG's request and supporting materials <br />provided by the CWCB staff, The Board "authorized an expenditure of up to $40,000" to fund activities <br />associated with the three states' negotiations and to complete the pending water court proceedings <br />involving the recharge project at the Tamarack State Wildlife Area, <br /> <br />. <br /> <br />Proiect Status: <br />Steve Sims has substantially concluded his services, on behalf of the Colorado, and the iitigation account <br />funds have been fully expended, A Finai Biological Opinion, a Final Environmentai Impact Statement and <br />Record of Decision are expected within the next month, Ted Kowalski, of the CWCB Staff, will take now <br />serve as the State's lead legal negotiator for the Colorado team, There have been some final duties that <br />Mr, Sims has participated in, and the Attorney General's Office has utilized some vacancy savings to fund <br />that work, <br /> <br />COLORADO RIVER LITIGATION <br /> <br />Attornev General Request: <br />Attorney General Ken Salazar, letter dated November g, 2005, requested $250,000, to "prepare to <br />adequately defend Colorado's allocations of the Colorado River in imminent litigation." More specifically, <br />the letter requested funds to accumulate a comprehensive archive and library of documents related to the <br />law of the river, create an imaging and indexing system to create a searchable database, and to pay for <br />equipment and/or travel costs associated with this potential litigation. <br /> <br />Colorado Water Conservation Board Action: <br />At its November 2005 regular meeting the Board reviewed the AG's request and supporting materials <br />provided by the CWCB staff, The Board "authorized an expenditure of up to $250,000" to fund activities <br />associated with the "preparation for possibie litigation and the defense and protection of Colorado's <br />allocation of water in the Colorado River," . <br /> <br />Proiect Status: <br />Colorado has hired a historian and has been working with an imaging consultant to assist in these <br />activities. Negotiations that may avert litigation are ongoing, but whether the negotiations will prove <br />successful is uncertain. <br /> <br />. <br />
