<br />I <br /> <br />I <br /> <br />Mr. Ten Evck: We have one other young man working with us this semester, <br />a Denver Public Schools administrative intern, who I hope will not be <br />completely disillusioned with our state government in the time he spends <br />in our department, Mr. Paul Markham, a senior of South High' School in <br />Denver. <br /> <br />Mr. Markham: Thank you. <br /> <br />Mr. Kroeger: Thank you, Tom. Glad to have you people with us this <br />day. <br /> <br />Are there other comments from the audience? Yes, several of them. <br /> <br />Mr; Blatchley: I am Ron Blatchley, Denver, Colorado, consulting engi- <br />neer. Also I represent the Consulting Engineer's Council of Colorado. <br />We plan to submit some written conunents concerning this regulation and <br />we very much approve of this particular type of regulation. One ques- <br />tion on page 6 of the proposed regulation I would like to have a clari- <br />fication. I see some problem in these particular exceptions. Is the <br />federal government subject to this regulation? This would be the first <br />question. <br /> <br />Mr. Starks: I doubt it. The federal government takes the position <br />that t is king on its own land. However, the tendency has been in <br />recent years that the federal government does try to adhere to local <br />regulations. They always make it clear that they don't feel that they <br />have a legal obligation to do so, but that they think that in the <br />interest of better relations they should conform to local ordinances. <br />By and large, I think you will find that the federal agencies are <br />willing to observe this type of regulation. <br /> <br />Mr. Blatchley: Okay. The other thing 1s that there is no provision <br />in here for any dike or dam or flood control structures that somebody <br />might want to put in to reduce the floodplain. <br /> <br />Mr. Sparks: That was not an accidental oversight. <br /> <br />Mr. Blatchley: Okay. How do you construct a dam such as Narrows? <br /> <br />Mr. Sparks: In that case, you are not increasing the flood hazard. <br />You can do anything that does not increase the flood hazard. <br /> <br />Mr. Blatchley: You are increasing the floodplain, however? <br /> <br />Mr. Sparks: Yes. But on the property owned by the dam builder. <br /> <br />u <br /> <br />Mr. . Blatchley: That isn't excepted in here, however? <br /> <br />Mr.::' Sparks: This is something we gave consi~erable thought to. We are <br />not sure that it is either. <br /> <br />Mr. Blatchley: But we have county and city regulations saying that any <br /> <br />-21- <br />
