I wasn't aware that this board had <br />the authority to establish penalties that Mr. Bermingham was talking <br />about. <br /> <br />Senator Bermingham: This board doesn't have authority to establish <br />penalties. All these are model regulations which is something that <br />the local government can look at and use for its purpose in devising <br />its own regulations. They have authority under their general authority <br />as a local government to adopt penalties. <br /> <br />It makes me think of one other comment I would make. As these are <br />developed, since they are model regulations, it might be appropriate to <br />include in them some comments from time to time (you can single space <br />them or something) for example to show that this definition of an <br />intermediate regional flood is one that has been used and developed by <br />the Corps of Engineers and is used throughout the entire United States. <br />That in itself, that type of comment, will prevent or tend to prevent <br />a local government from tinkering with a definition when their time <br />comes to look at this and develop its own regulations. Or for example <br />with floodplains, a question in my mind is, is this the identical <br />language that is in 1041, or is there a variation? To spell out these <br />changes I think would be helpful or lack of changes. My name is Kenneth Wright. <br />I live at 1440 High Street in Boulder. I am a consulting engineer in <br />Denver. I am a partner of Wright-Mclaughlin Engineers and president <br />of Wright Water Engineers. And I am also a city councilman of Boulder, <br />though I am not speaking for the City Council at this time, but only <br />for myself. Mr. Sparks mentioned the 1965 flood. 1 think that is one <br />of the reasons for being' here. 1 remember it very well. 1 had a <br />building two hundred feet from the South Platte River channel at Alameda <br />and we experienced that flood and saw it come through and saw the <br />disruption, social and urban, that it caused. At the same time I was <br />also engineer for Palmer Lake. I think 1 met Mr. Sparks when he was <br />with General Moffitt making their inspection. <br /> <br />My first comment related to much the same thing as Senator Bermingham <br />mentioned; namely, the need to integrate the floodplain regulation with <br />other state agencies but also with other state policies, and particu- <br />larly state land use policies. 1 would generally second Senator <br />Bermingham's remarks. <br /> <br />As far as the regulation is concerned, I think it is a good one and it <br />is very simple and I would support it very strongly. I do, of course, <br />have some suggestions. I feel that the regulation is long overdue. <br />I wish that the Water Board had taken this step some twenty years ago. <br />I feel that it could have saved the citizens of the state of Colorado <br />many hundreds of millions of dollars in future flood corrective works. <br /> <br />-15- <br />
