We are trying, and there has been <br />work as Larry ki'iOWs already, in pulling them together to some degree, <br />but I think further work is necessary. <br /> <br />Mr. Ford: Is this the U. S. Forest Service you are talking about? <br /> <br />Senator Bermin&h!m: No, it is our state forest service which works I <br />closely with toe U. S. <br /> <br />Mr. Ford: The U. S. Geological Survey? <br /> <br />Senator Bermingham: No, it is the Colorado, or both. <br /> <br />Mr. Ford: Who takes care of the Bureau of Land Management land, the <br />state forest service? <br /> <br />Senator Bermingham: Let me clarify something. These other agencies <br />are not concerned with flood regulations. The Forest Service is con- <br />cerned with areas of high hazard for forest fire and the Geological <br />Survey for avalanches and so forth. <br /> <br />Mr. Sparks: It makes no difference who owns the land. Whether it is <br />the United States Forest Service, or BLM, it is our responsibility as <br />far as the floodplain designation is concerned. And the same is true <br />with the other agencies. <br /> <br />Senator Bermingham: I might mention another reason of broadening the <br />base to include say House Bill 1034. House Bill 1041 had some quite <br />strict exceptions in it or exemptions for lands that are already zoned. <br />It might be in certain counties.' For 'ex!rihPle, I think Boulder County <br />is completely zoned. And if so, there is one body of legal opinion <br />that says that 1041 can never have "any effect in Boulder County because <br />it is already all zoned. There are others and eventually it may have <br />to be decided in court. So;if Boulder County wants to do something it <br />can get the benefit of your proposals if it ducks that question by <br />adopting the same type of proposal under House Bill 1034. <br /> <br />Mr. GeiSSin~er: Senator, let me ask you this question. Is there any- <br />thing in 10- ~that you have mentioned that has anything to do with the <br />identification problem? In other words, 1041 is the legislation that <br />is the basis for the identification problem and as I understand it <br />that will go through and there is nothing in 1034 that would block <br />this? Is that correct? <br /> <br />Senator Bermingham: I think you should plan to go as far as you can "1 <br />under 1041, but then at that point of truth the county or city may <br />feel it is already zoned, 1041 legally won't apply, or we want to do <br />something else, and not have this complicated and then slip under 1034 <br />for the final bite. <br /> <br />Mr. Kroeger: Any other comments?
