By no stretch <br />of the imagination did that constitute a <br />burden and couldn't be made to do so. It <br />was water that was down there that they could <br />use if it was there. It is there on the tri- <br />butaries. <br /> <br />The Supreme Court chose to ignore the <br />tributaries. She dealt only with the main <br />stem of the Colorado River. We were not <br />parties to the suit and we are not bound by <br />the fact the supreme Court did ignore the <br />tributaries in the Lower Basin." <br /> <br />"In your report you speak of a possi- <br />bility of salvaging some 220,000 acre-feet <br />down at Yuma. This would accrue only to the <br />credit of Arizona. Would it deduct from the <br />l~ million acre-feet that Mexico is entitled <br />to?U <br /> <br />"I'm glad you brought that poi,nt up, <br />Quincy. The Mexican Treaty burden needs <br />explanation because there is some misunder- <br />standing about it. There are knowledgeable <br />people who think that it's 750,000 ~cre- <br />feet on each Basin. That's not true. Right <br />at this moment out of the l~ million acre- <br />feet that the treaty allocated to Mexico, <br />there's 900,000 acre-feet at least that is <br />being taken care of by return flow and other <br />flows, such as desilting water, coming to the <br />river below Imperial Dam. Flows that are not <br />usable in the United states unless they are <br />pumped and there would be no point in pumping <br />them to, say the All American Canal, because <br />that doesn't relieve the situation. So the <br />burden on the two Basins to make up any <br />deficiencies in the Mexican Treaty delivery <br />might be only a total of 500,000 acre-feet, <br />600,000 acre-feet at the most. <br /> <br />Now this 900,000 that is coming to the <br />river right now is water that won't be shut <br />off; It comes from Arizona projects that <br />will not be effected. We'll say they have a <br />
