<br />. <br /> <br />DECREE PROPOSED FOR SETTLEMENT BETWEEN <br />SAN LUIS VALLEY IRRIGTION DISTRICT AND THE <br />COLORADO WATER CONSERVATION BOARD <br />MAY 13, 2005 <br /> <br />in this Plan for Augmentation, pursuant to a plan of substitution and exchange approved by <br />the State Engineer. <br /> <br />25. The Applicant currently has a storage agreement with the Reservoir <br />Company, owner of Santa Maria and Continental Reservoirs, which provides for the <br />storage of the District's water rights and release of sufficient quantities of water necessary <br />to meet the requirements of the District's Augmentation Program, This agreement may <br />require some modification to provide for the storage in Santa Maria and Continental <br />Reservoirs of BAR. Cattle Credit Water by exchange, which modifications shall be made <br />before B.A.R. Cattle Credit Water is exchanged and stored in these Reservoirs. <br /> <br />. <br /> <br />26, The Applicant's current agreement with the Reservoir Company specifies that <br />if water must be spilled from Santa Maria or Continental Reservoirs, the Reservoir <br />Company may exchange Applicant's stored water into the non-spilling reservoir or into Rio <br />Grande Reservoir, pursuant to a separate right of exchange between the Reservoirs <br />decreed in Case No, 90CW42. If such an exchange is not possible, the Company will not <br />spill the Applicant's water in storage. Also pursuant to that agreement, the Reservoir <br />Company may dedicate some of its water in storage to the Applicant for use as <br />augmentation water when the Applicant has insufficient water. In such a case, the <br />-Reservoir Company's water will be used in this Plan for Augmentation pursuant to a plpn of <br />,substitution and exchange approved by the State Engineer. c <br /> <br />27. The Applicant will attach standard information forms to well permit applications <br />and supply such forms to the Division Engineerfor other types of structures in the Plan for <br />Augmentation. The standardized forms utilized by the Applicant shall give sufficient <br />information concerning the structure and the proposed use of water to allow the Division <br />Engineer to accurately calculate the total depletion and the quantity and timing of out-of- <br />priority consumptive loss to the stream system, The State and Division Engineers shall <br />. ..-- -_ _J1ave.thediscretionlo.determinathe, informationaLrequi[ements.of the.sta.nggId.iz..e_d forms, <br /> <br />28. The Applicant shall submit these forms and any other necessary reports <br />showing the replacement requirement and supporting information to the Division Engineer <br />immediately upon acceptance of each structure into the Applicant's Augmentation Program <br />and shall submit reports showing uses of the water to the Division Engineer by November <br />10th of each year, or such other dates as are acceptable to the State Engineer, <br />29, The Applicant shall not include in this Plan for Augmentation any structures <br /> <br />. <br /> <br />Page 13 of 21 <br />
