<br />. <br /> <br />. <br /> <br />. <br /> <br />DECREE PROPOSED FOR SETTLEMENT BETWEEN <br />SAN LUIS VALLEY IRRIGTION DISTRICT AND THE <br />COLORADO WATER CONSERVATION BOARD <br />MAY 13, 2005 <br /> <br />Water may be exchanged from the confluences of the South Fork of the Rio Grande, Bear <br />Creek and Willow Creek with the Rio Grande mainstem for storage in Rio Grande <br />Reservoir, pursuant to the Applicant's agreement with the San Luis Valley Irrigation District <br />(the "Irrigation District"), and in Santa Maria and Continental Reservoirs pursuant to the <br />Applicant's agreement with the Santa Maria Reservoir Company (the "Reservoir <br />Company"), BAR. Cattle Credit Water stored by exchange in Rio Grande, Santa Maria <br />and/or Continental Reservoirs will be released upon demand by the State Engineer to <br />replace the out-of-priority depletions caused by Participating Structures, subject to the <br />terms of the agreements between the Applicant and the reservoir owners, <br /> <br />19, The Applicant formed the intent to appropriate this conditional right of <br />exchange no later than December 12, 2001, the date on which the Applicant entered into <br />an agreement with the Irrigation District for the storage of the District's water including, in <br />part, its BAR. Cattle Credit Water, in Rio Grande Reservoir. <br /> <br />20, BAR. Cattle Credit Water may be exchanged to the reservoirs described in <br />paragraph 22 below, in accordance with the following: <br /> <br />a, Flow rates for any exchange shall not exceed 3.72 c.f.s. The actual rate of <br />exchange shall be dependent on the calling priority and the available streamflow in <br />Bear Creek and Willow Creek, <br /> <br />b. The amount available for exchange in a given month shall be limited to the <br />following percentage of the total amount of water available for that year pursuant to <br />the terms of paragraph 14 above: <br /> <br /> April May June July August Sept Oct Total <br />- .5.4%. 13.2%. ..21.53L 23.4,% _1.8.8% . .J3.2%.. __4.,5 'Z'"-. .1.00%_ <br /> <br />c. The Applicant shall notify the Division Engineer prior to exercising the <br />exchange. <br /> <br />21, The Applicant will store BAR. Cattle Credit Water on a carried forward <br />annual basis in order to provide a sufficient source of augmentation water in times of <br /> <br />Page 110121 <br />
