<br />7~-1J-- DRAFT <br /> <br />. <br /> <br />to the meeting in which the staff IFNL recommendation will be <br />presented for Board consideration, staff shall cause a copy of <br />the staff recommendation to be mailed to the following persons: <br /> <br />(a) Any persons requesting notification. <br /> <br />(b) The county commissioners of the county in <br />which a subject stream reach is located. <br /> <br />(c) Any name supplied through consultation <br />with the Division Engineer. Staff shall ask the Division Engi~ <br />neer to identify those persons, landowners, governments, special <br />districts and water users who might desire additional notice. <br /> <br />(d) Failure to notify any person pursuant to <br />this section shall not invalidate any Board action nor shall lack <br />of notice be a ground for contesting the water right applied for <br />by the Board. <br /> <br />5.22 Public Comment. Members of the public shall be <br />entitled to comment on the staff recommendation prior to Board <br />action on the recommendation in any or all of the following man- <br />ners: <br /> <br />. <br /> <br />(a) Oral or written comments may be directed <br />to staff prior to the staff's presentation to the Board. When <br />such comments are made, staff shall summarize these comments to <br />the Board during staff's presentation of their recommendation. <br /> <br />(b) <br />directly to the Board <br />by the Board prior to <br /> <br />Oral and/or written comments may be made <br />during the public meeting to be conducted <br />taking action on staff recommendation. <br /> <br />5.23 Public Agency Recommendations. Prior to ini- <br />tiation of any appropriation, the Board shall request recommenda- <br />tions from the Division of Wildlife, the Division of Parks and <br />Outdoor Recreation, the United States Department of Agriculture <br />and the United States Department of Interior. The Board may also <br />request comments from other interested parties as it deems appro- <br />priate. <br /> <br />5.30 Board Action on IFNL Recommendation. The Board shall <br />hold a public meeting in which the staff recommendation is dis- <br />cussed. At the public meeting the Board shall consider presenta- <br />tions of staff, and all public and agency comments. After such <br />consideration, the Board may adopt, modify or reject the staff <br />recommendation.
