Rules and Regulations concerning the implementation <br />of the Colorado Instream Flow and Natural Lake Level Program, as <br />established in SS 37-92-102 and 103, C.R.S. (1990), shall be <br />hereinafter referred to as the "IFNL" Regulations. <br /> <br />2.00 PURPOSE OF RULES AND REGULATION. The purpose of these <br />Rules and Regulations is to set forth the procedures to be fol- <br />lowed by the Colorado Water Conservation Board when implementing <br />the IFNL Program. <br /> <br />3.00 STATUTORY AUTHORITY. The General Assembly created the IFNL <br />program in recognition of the need to correlate the activities of <br />mankind with some reasonable preservation of the natural environ- <br />ment. The Statutory Authority for these Regulations is found at <br />SS 37-60-108 C.R.S. (1990) and SS 37-92-102 and 103, C.R.S. <br />(1990) . <br /> <br />4.00 DEFINITIONS. <br /> <br />4.10 Board. Means the Colorado Water Conservation Board <br />as defined in SS 37-60-101, 103 and 104, C.R.S. (1990). <br /> <br />4.20 Staff. Means the Director of the Water Conservation <br />Board and other personnel employed by the Board. <br /> <br />4.30 Person. Means any human being, partnership, corpora- <br />tion, municipal entity, county government, state government or <br />agency thereof, federal government or agency thereof, quasi- <br />governmental entity, or any association. <br /> <br />4.40 IFNL. Means any decreed instream flow water right or <br />any natural lake level water right. <br /> <br />5.00 ORIGINAL APPROPRIATION PROCEDURE <br /> <br />5.10 Recommendation of Streams and Lakes for Prot~ction. <br />The Staff shall periodically seek Board approval of streams and <br />lakes to be studied for inclusion in the IFNL Program. <br /> <br />5.11 All persons interested in recommending certain <br />stream reaches or natural lakes for inclusion in the IFNL program <br />may make recommendations to Staff at any time. <br /> <br />5.20. Public Review Process. The following public review <br />process must be followed prior to Board adoption of the Staff <br />IFNL recommendation for appropriation of a water right. <br /> <br />5.21 Public Notice.
