The Board by 260 <br /> <br /> <br />protecting its IFNL rights from inundation does not intend to <br /> <br />create a land use regulation, wild and scenic river regulation, 262 <br /> <br />or water right administration regulation separate from existing 263 <br /> <br />state water right administration practices. <br /> <br />The Board does not seek to duplicate federal, state and local 266 <br /> <br />government requirements for permits required in order to con- 267 <br /> <br />struct a water project and therefore the Board shall make its de- 268 <br /> <br />cision under section 8 after first considering these other 269 <br /> <br />regulatory requirements imposed upon applicant. The Board may 270 <br />seek different conditions or compensation if the other governmen- <br /> <br />tal agencies have not adequately protected the Board's IFNL <br /> <br />271 <br /> <br />rights from interference or if the other agencies have not <br /> <br />272 <br /> <br />obtained sufficient compensation to redress the impact/damages 273 <br /> <br />suffered by the Board for the interference done to the Board's 274 <br /> <br />IFNL right. <br /> <br />Although many persons may be interested in preventing inter fer- 277 <br /> <br />ence or seeking adequate compensation for interference to IFNL 279 <br /> <br />rights caused by inundation, the Board is the appointed govern- 280 <br /> <br />mental body charged with acquiring and protecting IFNL decrees 281 <br /> <br /> <br />for all persons of the State of Colorado.
