Town of Breckenridge

Staff has reviewed the agreement and would recommend it as technically and
financially feasible, although there is some disagreement as to the ultimate effect of the
agreement. Staff has attended some of the Technical Work Group meetings which related
to instream flows, and has also reviewed the draft agreement between Denver and the
Purchasers group. There are still some instream flow issues that need to be addressed before
the Board's contract with the purchasers is finalized and funds are dispersed. I have attached
a letter from Wendy Weiss to Glen Porzak which sets forth most of the concerns.
Additionally, I have attached the June 17, draft agreement with the Denver Water Board
which addresses the technical feasibility of the Clinton Reservoir in conjunction with Denver
Water Board exchanges. Staff will meet with Clinton representatives prior to the July
meeting to address these concerns. It will take a year before operating plans are in place,
but if staff concerns are resolved, then the technical feasibility aspect should be met.

The fmancial feasibility is being addressed by Frank Akers, and if he finds the project
participants to be fiscally sound I would hope the Board will approve signing the contract.

SD/bj
Attachments

bj641.10b
