<br />I <br /> <br />and by members of th~ Corps of Engineers. The <br />red line as shown on this map is the calculated <br />flood plain as it will exist after Chatfield Dam <br />is built. If the channelization is not accom- <br />plished that land is going to be subject to <br />flooding and some provision needs to be made <br />for it. We recognize this as one need which <br />needs to be taken into account. <br /> <br />We also realize that the Chatfield Dam design <br />is based on criteria of Colorado water law and <br />that Colorado water law is a very real and <br />legally binding set of doctrines which must be <br />taken into account. We can't ignor that doctrine. <br />It is something that we have to work with. <br /> <br />We also recognize the position of the <br />Colorado Water Conservation Board as the 'local <br />entity' who is responsible for acquiring the <br />lands of the channelization that can be aCCOm- <br />plished downstream. <br /> <br />The City Council is further aware of the <br />design as set forth in Design Memorandum PC-20 <br />of the Corps of Engineers. We have seen the <br />conceptual studies of the so-called 'soft treat- <br />ment' which would be used for beautifying the <br />river channel once it is constructed. <br /> <br />Finally, the City Council is aware of the <br />funding appropriations which have been made for <br />this particular project. The corps of Engineers <br />has not been funded, to our knowledge, to actually <br />begin earth moving during this fiscal year. <br /> <br />I <br /> <br />We further realize that the State through its <br />water board, has approved $200,000 to begin <br />land acquisitions basically on the upstream end <br />of the channel as proposed. <br /> <br />In summary, the City Council in preparing <br />this paper is not coming in cold turkey and <br />saying we are not aware of the facts. We feel <br />that the Council has made every effort to make <br />itself aware of the facts and these facts have <br />to be taken into account. However, the Council <br />
