red line as shown on this map is the calculated
flood plain as it will exist after Chatfield Dam
is built. If the channelization is not accom-
plished that land is going to be subject to
flooding and some provision needs to be made
for it. We recognize this as one need which
needs to be taken into account.

We also realize that the Chatfield Dam design
is based on criteria of Colorado water law and
that Colorado water law is a very real and
legally binding set of doctrines which must be
taken into account. We can't ignor that doctrine.
It is something that we have to work with.

We also recognize the position of the
Colorado Water Conservation Board as the 'local
entity' who is responsible for acquiring the
lands of the channelization that can be aCCOm-
plished downstream.

The City Council is further aware of the
design as set forth in Design Memorandum PC-20
of the Corps of Engineers. We have seen the
conceptual studies of the so-called 'soft treat-
ment' which would be used for beautifying the
river channel once it is constructed.

Finally, the City Council is aware of the
funding appropriations which have been made for
this particular project. The corps of Engineers
has not been funded, to our knowledge, to actually
begin earth moving during this fiscal year.

We further realize that the State through its
water board, has approved $200,000 to begin
land acquisitions basically on the upstream end
of the channel as proposed.

In summary, the City Council in preparing
this paper is not coming in cold turkey and
saying we are not aware of the facts. We feel
that the Council has made every effort to make
itself aware of the facts and these facts have
to be taken into account. However, the Council
