EP A action on Colorado's 2004 Section 303( d) List
On July 26,2004, the EPA partially approved and partially disapproved Colorado's section 303(d) list submittal
for the 2004 listing cycle.
EP A approved listing of 117 water bodies, associated pollutants, and associated priority rankings.
EPA disapproved Colorado's decisions not to list six water bodies and associated pollutants.
EP A is providing the public the opportunity to review its decisions and provide comments for the Colorado 303
(d) list by September 20, 2004.
Among EP A's disapprovals is the Dolores River, where water temperature and aquatic life are the basis for
disapproval. Temperature is considered a pollutant that would impair aquatic life. EPA's consideration may
have implications on water quantity (reservoir releases).
Commissioners Ament and Doug Benevento, as well as Senator Allard have sent comment letters to the EPA,
emphasizing the potential water quantity management implications of requiring a listing of the Dolores River.
Frank McNulty will coordinate a response to the docket at EP A with all state agencies to sign onto to serve as
the state's formal response to EP A's proposed listing of the Dolores River.

Colorado Watershed Protection Fund (CWPF) Update
The Department of Revenue's figure of tax checkoff contributions for the CWPF as of June 30th was $96,800.
Because this amount was less than anticipated, the CWCB agreed to only charge $10,000 for its expenses this
year. The total amount available for grant after accounting and CWCB expenses is approximately $84,000.
Staff has recommended that the CWPF Designees allocate this money to five project grants and three planning
grants. The CWPF Designees will make its decision before the end of August.

EPA Action Regarding Discharge Permits For Transbasin Water Diversions
Colorado, along with a number of other western states, has filed an amicus brief in Catskill Mountain Chapter of
Trout Unlimited vs. City of New York in the U.S. Court of Appeals for the 2M Circuit.
