Walker <br />Deputy Director <br /> <br />FROM: <br /> <br /> <br />DATE: <br /> <br />SUBJECT: Public Rulemaking Hearing Concerning the Proposed <br />Rule for the Designation and Approval of Floodplains <br /> <br />As you know, the subject hearing will be held at 1:45 p.m. <br />on October 1 as an agenda item of the Board's October 1-2 <br />meeting. The notice of the hearing, proposed rules, proposed <br />statement of basis and purpose, and proposed statement of <br />fiscal impact have been furnished to you previously under cover <br />of my August 28 letters to the Secretary of State and the <br />Division of Regulatory Reform. <br /> <br />with respect to the hearing and rule adoption process, r <br />would appreciate your guidance on the following: <br /> <br />(1) <br /> <br />Does the agenda for the Board meeting, which is <br />mailed out to our standing mailing list, need to say <br />anything special about the hearing, be posted in a <br />pUblic place, or be mailed out by a particular date? <br /> <br />OK <br /> <br />(2) <br /> <br />The proposed rule, dated August 28, has been mailed <br />to numerous parties. although it will not be <br />published in the Colorado Reqister. That being the <br />case, can the proposed rule be changed up to five <br />(working?) days prior to the October 1 hearing and , <br />still be adopted, if not changed further, on October <br />1? Do changes to the August 28 version have to be <br />provided by us to those to whom we mailed that <br />version at least five (working?) days prior to <br />October 1 in order for the Board to be able to act on <br />October 1? <br /> <br />'fbt- <br /> <br />(3) <br /> <br />Whatever the answers to (2), and assuming we comply <br />with the requirements of those answers. can the Board <br />adopt the rule proposed as of five days prior to <br />October 1 at its October 1 meeting if it wants to <br />make changes to it, or must at least f!~.
