The Applicants agree that diversions pursuant to the <br />decrees herein involved at the alternate point requested in this <br />matter during times when the instream flows in the Eagle River <br />are at or below the adjudicated minimums as described in 80CWl34, <br />will not exceed 2.0 c.f.s. <br /> <br />7. The Water Conservation Board hereby acknowledges that <br />with applicant's agreement to reduce diversions as herein <br />described, no injury will result (or any injury that would result <br />shall be mitigated) to the instream flow decrees of the Colorado <br />Water Conservation Board and the natural environment will be <br />preserved to a reasonable degree. <br /> <br />8.
