Such conditions could include requirementS for maintaining <br />certain flows or surface levels or timings of flows, that <br />approximate "natural" flews and levels or protect recreation, <br />scenic, ecological or other wilderness values. <br /> <br />The p~rmits and Forest Ser-vice regul"tions pr-ovide for suspension <br />or revocation of per-mitS in cases of unauthor-ized use of NFS <br />lands and r-esour-ces. Any water development implemented without <br />land use authorizaticn or ,n violation of the conditions imposed <br />in such authorization may constitute a tr-espass, which the Forest <br />Service would refer to the Department of Justice for <br />pr<.lsecution. <br /> <br />Application in Colorado: ;he Fares t Service will ei ther deny or- <br />impose protective conditions in any per-mit or- r-ight-of-way for <br />water development on NFS lands within or above a wilderness that <br />would affect wilderness values as established by Congress. Of <br />course, the specific restrictions thac would be imposed, such as <br />stream flow timing or- qUlilltito' requirements, may var-y according <br />to the factual circumstances of each case, but the objective. <br />i.e., preservation of wilder-ness characteristics, does not. <br />Unauthorized uses of NfS lands which adversely affect wilderness <br />will be referred to th~ Department of Justice for prosecution. <br /> <br />. <br /> <br />(2) !"ollowing the desi;rr.aUor. of a wilderness tber-e cannot be any <br />wa:er res(Jurces de\.'el::,pmt:::nt '.:m F€'deral lands within the wilder- <br />ness area unless it ha9 b","n allthodzed by the President under- <br />Section 4(d) (4) of 'h., \o;iLbmess '\.ot, !6 U.S.C. l133(d) (4).
