The Forest Service will utilize one or more of the following management
mechanisms to protect the water and water dependent resources to meet the
National Forest management responsibilities:

a. Administrative control
b. Appropriation under State water laws
c. Reserved water right claims under Federal law
d, Acquisition of land or water rights
e. Condemnation of lands or water rights

Administrative Control

Consistent with applicable laws. the Forest Service will deny
permission for or impose protective conditions on any land use
authorization for any activity on NFS land outside of, but in a
position to affect water resources of any designated wilderness.
Likewise, in situations where the proposed activity is beyond the
direct administrative reach of the Forest Service. the Forest Service
will recommend to the President, the Congress. and any responsible
Federal agency that the proposed development be restricted to the
extent necessary to protect the wilderness water resource and the
public interest. There .are ~umerous forms that this administrative
action may take:

(1) Before diverting, s~ori~g or otherwise developing water resources
on NFS lands, a water user must apply for a right-of-way permit
under the Federal Land Policy and Management Act of 1976 (FLPMA).
An environmental analysis required by the National Environmental
Policy Act of 1969 (NEPA), q2 U.S.C, q321 et seq" would be com-
pleted for each application to develop terms and conditions to be
included in any right-of-way permit which may authorize the use
of Federal lands for water resource development, NEPA directs
the Forest Service to aI1alyze the end ['onmen tal, and related
social and economic impacts of proposed water resource develop-
ments on NFS lands. The Forest Service has developed an environ-
mental analysis proceduce that provides a systematic, interdisci-
plinary, public-oriented approach to decision making regarding
resource developments on NFS lands. This procedure is found in
the Forest Service Manual and Handbook, FSM 1950 and FSH 1909.15.
respectively. and is published at 50 Fed. Reg. 26078 (June 2q,
1985), as revised in 52 Fed. Reg. 30935 (August 18, 1987).
