<br />~". <br />F'\ <br /> <br />;~ <br /> <br />, <br />. <br /> <br />Property Acquisition <br />On March 1, CDOW exercised its option on the Chiles property for a purchase price of <br />$1.10 million. Closing is expected to occur no later than June 30, 1998 in accordance <br />with the terms of the purchase agreement. <br /> <br />. <br /> <br />Feasibility Summary Report <br />The CWCB and CDOW staffs are currently compiling a feasibility summary report on the <br />NASF based on the requirements in the CWCB Construction Fund Guidelines. The report <br />will draw primarily from existing documents prepared over the last several years as <br />updatedJor recent developments. Feasibility work is expected to be completed by the <br />end of March. <br /> <br />Some of the issues being addressed in the report are: <br /> <br />· the adequacy of the water rights and wells included in the purchase of the Chiles <br />property, <br /> <br />· water quality testing in terms of suitability of the well water for use in the facility, and <br /> <br />· possible impacts and permitting of the facility. <br /> <br />Memorandum of Understandine <br />A memorandum of understanding (MOO) between the CWCB and CDOW for the design, . <br />construction, and initial operation of the facility has been drafted by the staffs of the two <br />agencies (copy attached). The major provisions of the MOO are: <br /> <br />· Total disbursements by the CWCB to CDOW under the MOO will not exceed $2.0 <br />million of which no more than $200,000 will be allocated to operation and <br />maintenance costs. <br /> <br />· Total disbursements under the MOO for construction, operation and maintenance will <br />not exceed 40 percent of the actual cost to construct, operate and maintain the facility <br />for three years following completion of construction. <br /> <br />· The CWCB will not disburse any grant funds prior to closing by the CDOW on the <br />Chiles property. <br /> <br />· CWCB staff will participate in design and construction activities including selection <br />of the design engineer, review of plans and specifications, construction bid opening, <br />site visits, and approval of pay estimates for CWCB 's portion of construction costs. <br /> <br />· The facility will be owned and operated by the CDOW but operation and maintenance <br />will be undertaken in consultation with the CWCB on an annual basis regarding <br />budget, research and genetics, production, and goals for augmentation. . ~ <br /> <br />2 <br />
