AND 9SCW1SS & 156 IN DIVISION 6) <br /> <br />Dear Peter: <br /> <br />I am writing to reiterate the River District's position about the CWCB's base flow and <br />recovery flow claims which I reported at your November 23, 1998 meeting. It is our understanding <br />that the CWCB will consider this matter at its meeting in January. Please provide this letter to the <br />Board with their meeting package. <br /> <br />The River District's Board determined at its November 17ili meeting to advocate the <br />withdrawal of all of these claims. The Board's decision is the culmination of careful consideration <br />and lengthy discussions at Board meetings held in June, October and November ofthis year. The <br />Board's decision is a recognition that the pending claims serve no useful purpose; it is not a reversal <br />of the River District's policy that instream flows for the protection of endangered fish should be <br />adjudicated by CWCB if they contribute to the recovery of those species. <br /> <br />The River District historically has been a strong supporter of the Recovery Program. Before <br />these claims were filed, the District's staff and Board recognized that the recovery flows would not <br />protect habitat for the endangered fish in the near-term. Nevertheless, the Board supported the filing <br />of the claims in order for the Fish & Wildlife Service to. continue to determine that "sufficient <br />progress" was being made towards the recovery and ultimate delisting of the species. After the <br />claims were filed, the River District supported the efforts of the CWCB and the Attorney General's <br />Office to promote negotiations regarding the claims.
