HORN' (t!IitiJ) <br /> <br />Mr. Peter Evans <br />Colorado Water Conservation Board <br />1313 Sherman Street, Room 721 <br />Denver, Colorado 80203-2279 <br /> <br />Re: Case No. 95CW296 and 95CW297, Water Division No.5 <br /> <br />Dear Peter: <br /> <br />. <br /> <br />The following comments on the pending CWCB instream flow <br />filings for the Fifteen Mile Reach are submitted on behalf of' <br />Colorado Springs Utilities (CSU). <br /> <br />In general, CSU agrees with those comments filed by Tom <br />Pitts for'the Upper Basin Water Users. In particular, before any <br />action is taken concerning the withdrawal of either filing, USFWS <br />should explain, in writing: (i) the implications of such an <br />action upon the Section 7 Agreement; (ii) the specific <br />modifications to the proposed decrees which USFWS believes are <br />necessary to garner its support; and (ii) any acceptable <br />alternatives to the flow filings of which USFWS is aware. CSU is <br />particularly concerned that there be in place a mechanism for <br />protection of the species and its habitat which would allow for <br />the eventual "delisting" of the species. However, no matter what <br />flow alternative is eventually chosen, it must operate within the <br />framework of state water law and respect all rights decreed <br />thereunder to the extent of their full entitlement. <br /> <br />. <br /> <br />CSU appreciates your efforts and those of Wendy Weiss in <br />seeking comments upon both the future of the flow filings and the <br /> <br />...\1......""\_~_\'......\..u"'_.. 1lI!.,,, <br />
