We ,', <br />understand the Board will be considering how to proceed with these filings during its <br />July meeting in Telluride. ' <br /> <br />As you know, during the formulation of the Colorado River Recovery Program <br />(Program), tht:state successfully fought to get the U.S. Fish and Wildlife Service <br />(USFWS) to recognize that any water rights acquired by the Program for the fish <br />must be acquired and adjudicated under state law. This accomplishment, as well as <br />the recognition that the dual goals of the Program were to recover the four <br />endangered fish while allowing the state to fully develop its compact entitlements, <br />were both extremely important achievements by the state and the water users in <br />negotiating the basic parameters of the Program. <br /> <br />'We are concerned that the USFWS's support for acquiring water rights under state <br />law will be jeopardized ifthe Board's instream flow filings in the 15-Mile Reach are <br />withdrawn at this time. Such a move is not only premature, but unnecessary. As you <br />know, the state, along with water users, environmentalists, arid the USFWS are <br />exploring many different alternatives to ensure a permanent dedication of water to <br />the fish in the IS-Mile Reach. It would be unwise to limit the tools available to the <br />state to protect flows under state law by withdrawing the filings at this time. <br />
