<br />. <br /> <br />The District is concerned, perhaps overly 50, that the US Fish and Wildlife Service (the <br />Service) ....ill now look to the Section 7 process as an alternati....e means to procure water <br />for fish flows. Such an approach, which could subject individual projects to extraordinary <br />RP A requirements (RP As beyond those in the Recovery Program RIPRAP), would be <br />outside the spirit and intent of the RecovetY Program. We trust the CWCB shares our <br />concern and would fight any such attempt by the Service. And, we ask that the CWCB <br />take action to seek the necessary assurance from the Ser....ice that such an approach "...ill <br />not be a part of their alternative plans for flow protection. Such assurances should be <br />secured prior to seeking entry of a final decree in the Base Flow case. <br /> <br />It is vitally important that efforts to craft a workable programmatic IS.mile reach <br />biological opinion continue and come to positive resolution in a timely manner.
