Conditions for the Easement - If the easement is granted, the owner shall comply with the
following conditions:

1) TIME PERIOD - The EASEMENT shall be for a term of 25 years.

2) PERMITS - The owner shall be responsible for securing and monitoring all required
federal, state, and local permits pertaining to Colorado waters and streams.

3) INSURANCE COVERAGE - The CWCB shall be named as an additional insured, and
shall have coverage in the amounts established by the Colorado Governmental Immunity
Act - part one of article 10 of title 24, lOa C.R.S., as amended.

4) FEE CONSIDERATIONS - A recommendation will be made that is in compliance with
the standard fee consideration.

5) RECLAMATION OF THE SITE - A reclamation plan shall be developed and provided
to the CWCB for approval prior to the completion of the project.

6) NON-EXCLUSIVE EASEMENT CLAUSE - Language will be stated in the easement
that will reserve the CWCB's right to grant additional easements on the same land
covered by this easement.

REQUESTED EASEMENT

Action Requested:
For the Ron Koch Company's proposed water line, an easement is requested for the construction
of a 6-inch water line within the CWCB project right-of way (ROW). The staff recommends that
the minimum width be granted for the construction of the water line. This width will be
determined upon the submittal of fInal construction drawings and a controlled project fIeld
survey.

RECOMMENDATION

Following a review by the AG's Office and CWCB staff for Agenda Items 4.b.i, a
recommendation is as follows:

Approve the easement request from the Ron Koch Company for the construction of a 6-
inch water supply line in a restricted right-of-way alignment within the right overbank as
approximately delineated on Exhibit A. Grant the authorization to the staff to prepare the
necessary easement documents.
