<br />. <br /> <br />The move toward an opinion was facilitated by a Yampa Management Team comprised of state, <br />local, federal and water user representatives that has been meeting since about 1990. This team identified <br />that at least one of the endangered fish species is doing well, and that the fish are very resilient. The team <br />learned that if a projected consumption of an additional 50,000 acre feet occurs over the next 50 years, <br />some additional water may be needed to ensure the species recovery (the Yampa basin "produces" more <br />than I million acre feet annually). With this in mind, it was decided that not every issue may need to be <br />resolved immediately and that an opinion could be drafted that provides assurances for all the basin's <br />inhabitants that water will be available for their needs, while recovering the endangered species. The next <br />meeting is scheduled to be held in Steamboat Springs on October 6. <br /> <br />Lower Elk River Streambank Stabilization: At the July meeting in Steamboat Springs, we <br />observed lots of interest in the Lower Elk River Flood Study to address streambank stabilization problems <br />and watershed hydrology issues. The Routt County Sheriff advises that he has no doubt we will have <br />trouble with flooding at this location again next year and that, if the embankment fails, the state highway <br />will be lost. We responded to these concerns by producing a scope of work ("Elk River Streambank <br />Stabilization and Limited Watershed Hydrology Study") and executing 60-day engineering contract with <br />ICON Engineering, Inc. on September 13, 1999. We expect to have the results of this investigation by the <br />first of November and will work closely with the Lower Elk River Flood Association, Upper Yampa <br />River Conservancy District, CDOT, Corps of Engineers, and Routt County. <br /> <br />. <br /> <br />Water Supply Planning and Finance Program <br /> <br />Town of Palisade Collateral Change: In November 1997, we approved an increase of $172,000 <br />to a 1994 loan to the Town of Palisade to finance the replacement of the Cottonwood Creek Pipeline. <br />After discussing potential sources of collateral, you approved the loan and delegated the final decision to <br />me. During contract negotiations, the Town's bond counsel informed us it could not convey a security <br />interest in its real property or the pipeline because it lacks the statutory authority.
