Mr, Sam Maynes, counsel for <br />the ute Tribes, stated the tribal councils prefer to settle, and <br />they support Animas-La Plata and Dolores projects as a basis for <br />reaching accommodation. <br /> <br />Chairman Jackson commented to Mr. Pascoe that negotiation <br />with the tribes would be desirable for its possible contribution <br />to construction of Animas-La Plata. <br /> <br />He commented to Mr. Danielson that the five-year tabulation <br />of rights is cumbersome, There was discussion of the relation- <br />ship between. tabulation and right of ownership, Several <br />commented on the desirability of recording ownership which <br />existing tabulation doesn't provide, It was agreed to put the <br />matter on the next agenda for potential Board support of the <br />legislation, <br /> <br />To introduce agenda items 7, 8, and 10, Mr, Walker called <br />attention to the materials provided and then emphasized the <br />interrelationships between the items and the new issues raised by <br />several project proposals. The discussion then proceeded through <br />the items for information with action to follow. (See Ap~ndix <br />B-1.') <br /> <br />The memorandum provided for item 7a (see Appendix B-2) <br />summarizes the status of the construction fund which has a <br />current estimated balance of $14,26 million, The five existing <br />financing mechanisms are also discussed as are the issues which <br />arise from the project activities and proposals in the remainder <br />of item 7 8, and lOb, In particular, projects are not now <br />eligible for nonreimbursable support by statute or for more than <br />50% support by Board policy, <br /> <br />Mr, Pascoe then discussed item 7b concerning state cost <br />sharing in federal project development, He reviewed the <br />conclusion, based upon discussions with Department of the <br />Interior officials, that regardless of other commitments, that <br />some front-end cost-sharing is a prerequisite to a new project <br />start. Despite the lack of knowledge about requirements for <br />state participation, he recommended that the Board forward to <br />the legislature a request for authorization to expend construc- <br />tion fund moneys to negotiate with the federal government for <br />project starts on Narrows and Animas-La Plata, Such action, if <br />approved, would show Colorado's determination to participate, <br />Rules of participation could be negotiated, once Colorado's <br />position is clear, since formal procedures are unlikely for some <br />time. <br /> <br />-3- <br />
