Invitation for bids is imminent with a contract award <br />scheduled for July, 1982. <br /> <br />The Bureau of Reclamation Upper Colorado Regional Director, <br />Cliff Barrett, has responded favorably to the Director's request <br />that concluding reports be deferred on the West Divide, San <br />Miguel, and Grand Mesa projects and that Bureau assistance will <br />be provided to CWCB and the local sponsors in reformulation <br />activities for West Divide. <br /> <br />I <br /> <br />Current congressional proposals of interest to the state <br />were briefly discussed for background. <br /> <br />Mr, Montgomery presented the Attorney General's report. He <br />mentioned the state's recent intervention in the Wildcat <br />Reservoir case now that the case is proceeding to trial on the <br />merits. <br /> <br />He also discussed the Indian reserved water rights issue and <br />emphasized the magnitude of the potential impact should their <br />claims be won. Mr, Pascoe commented that the state's costs for <br />anticipated litigation is very high and a budgetary request is <br />under consideration. <br /> <br />The State Engineer's report was then presented by Mr. <br />Danielson, He first discussed some issues in the South Platte <br />basin involving Nebraska. Concerns have arisen over the Perkins <br />County canal involving winter diversions and export of water from <br />South Platte into High Plains areas, As a consequence, the South <br />Platte Commission may meet for the first time since 1923. <br /> <br />In the Arkansas River area, there are issues over storage <br />in Trinidad Reservoir and general storage operations in the <br />drainage in relation to compact deliveries to Kansas. <br /> <br />He reported that the activities of the Rio Grande Commission <br />are stymied by the death of the U.S. commissioner. Over- <br />deliveries are being controlled for Closed Basin recharge. <br /> <br />The interim Committee on Agriculture and Natural Resources <br />has recommended to the General Assembly a proposal to register <br />water rights. He observed that such a program would aid in <br />administration. <br /> <br />with the assistance of Chuck Lyle, Division 7 engineer, he I <br />then provided a thorough discussion of the Indian reserved rights <br />situation in division 7, The central concern is the potential <br />1868 priority date which is senior to any existing rights, <br />Conseqently significant losses of water supply for non-Indian <br />lands could occur, estimated to be 33,000 acres from a total of <br />171,400 acres now irrigated.
