<br />. <br /> <br />. <br /> <br />. <br /> <br />10.53 On the written request of any person made within thirty days after the date of the first <br />public meeting, the Board shall delay the subsequent public meeting for up to one year to allow such <br />person the opportunity for the collection of scientific data material to the proposed decrease. The <br />Board need not grant the request if it determines that the request is made solely to delay the <br />proceedings. <br /> <br />10.54 On the written request of any person made within thirty days after the date of the first <br />public meeting, the Board shall, within sixty days after such request, establish fair and formal <br />procedures for the subsequent public meeting, including the opportunity for reasonable disclosure, <br />discovery, subpoenas, direct examination, and cross examinations. Subject to these rights and <br />requirements, where a meeting will be expedited and the interests of the participants will not be <br />substantially prejudiced thereby, the Board may choose to receive all or part of the evidence in written <br />form. <br /> <br />12.01 Public Notice. Official notice of all ISF actions shall be set forth in the notice and <br />agenda of each regular or special Board meeting. To provide the public notice in section 5.23, a <br />supplementary notice of the ISF action shall be mailed within five working days of passage of the <br />Board resolution to the following persons: <br /> <br />(a) Any person requesting notification; <br /> <br />(b) The county commissioners of the county in which the proposed action is located; <br /> <br />( c) Any name supplied through consultation with the Division Engineer; and <br /> <br />(d) The Board shall exercise its best efforts to notice all persons pursuant to this <br />section, however, failure to mail a supplementary notification to any person shall not invalidate any <br />Board action nor shall such lack of notice be raised as a defense to any Board legal action. <br /> <br />12.04 BOARD PROCEDURES. At a regular or special Board meeting, the Board may, as <br />necessary, adopt or amend procedures to supplement these rules.
