<br />. <br /> <br />. <br /> <br />. <br /> <br />ATTACHMENT B <br /> <br />STATEMENT OF BASIS AND PURPOSE FOR CHANGES TO ISF RULES 2 CCR 408-2. <br /> <br />Subsection 5.23 Date of Aooropriation. This subsection provides that the Board may select an <br />appropriation date that may be no earlier than the date the Board passes a resolution directing the staff <br />to publicly notice the Board's intent to appropriate an ISF right. This subsection is designed to <br />facilitate maximum public participation in the ISF appropriation decision process, at the same time <br />permitting the Board to establish its appropriation date early in the process. <br /> <br />Section 10 - Modification ofISF Rights <br /> <br />The General Assembly adopted S.B. 96-64, enacted on May 23, 1996 and codified as g37-92- <br />I 02(4). These regulations implement the procedures established by S.B. 96-64. <br /> <br />Subsection 12.01 Public Notice. This subsection is amended to provide that a supplementary <br />notice of the ISF action required in 5.23 shall be mailed within five working days of passage of the <br />Board resolution to individuals specified in the previously enacted version of this subsection. <br /> <br />Subsection 12.04 BOARD PROCEDURES. This subsection provides a process for adopting <br />or amending procedures to supplement these rules. This subsection "grandfathers" procedures <br />adopted by Board on May 12, 1997, as being adopted pursuant to this rule. <br /> <br />Subsection 13.01 AMENDMENTS EFFECTIVE DATE. This subsection establishes the <br />effective date for these amendments. <br />
