<br />. <br /> <br />.. <br /> <br />. <br /> <br />REAL ESTATE COMMISSION ADOPTS COGCC RECOMMENDATIONS: The Colorado Real <br />Estate Commission has adopted the COGCC's recommendation that a unifonn provision be included in <br />every contract to buy or sell real estate. The provision expressly references the need to diligently <br />investigate whether the mineral estate has been severed. <br /> <br />The COGCC suggested the following language be included in every contract: <br /> <br />f, Title Advisorv. The Title Documents affect the title, ownership, and use of the <br />Property and should be reviewed carefully. Additionally, other matters not reflected in the Title <br />Documents may affect the title, ownership and use of the Property, including without limitation <br />boundary lines and encroachments, area, zoning, unrecorded easements and claims of easements, <br />leases arId other unrecorded agreements, and various laws and governmental regulations <br />concerning land use, development and environmental matters. The surface estate may be owned <br />separately from the underlying mineral estate, and transfer of the surface estate does not <br />necessarily include transfer of the mineral rights. Third parties may hold interests in oil, gas, <br />other minerals, geothennal energy or water on or under the Property, which interests in may <br />give them rights to enter and use the Property. Such matters may be excluded from the title <br />insurance policy. Buyer ids advised to timely consult legal counsel with respect to all such <br />matters ~s there are strict time limits provided in this contract (e.g., Title Objection Deadline [~ <br />2cJ and Off-Record Matters ObjectionD~a~line [~ 2c D. <br />, .-' <br /> <br />Division of Parks and Ontdoor Recreation (State Parks) <br /> <br />NEW PARKS BOARD MEMBER APPOINTE!>: Governor Bill Owens has appointed Doug Cole to <br />the Board of Parj(s and Outdoor Recreation for a telm"~xpiring June 30, 2002. Cole is from Superior and <br />will serve as an at-large member. He is the presidel1t arid chief executive officer for the Longmont <br />Chamber of Commerce and is chair-elect of the Colorado Chamber of Commerce Executives. He also <br />served as the executive director for the Broomfield Chamber of Commerce from 1996-1998. <br /> <br />Gov. Owens will continue the appointment ofEdw~rd C. Callaway from Crested Butte to serve as a <br />representative of the western region. <br /> <br />NATURAL AREAS PUBLIC HEARING: The Colorado Natural Areas Program, at the request of the <br />Gunnison Board of County Commissioners, held a public hearing on Feb. 16 in Gunnison to discuss the <br />designation of the Mount Emmons Iron Bog, located a few miles west of Crested Butte, as a Colorado <br />Natural Area. The area is an unusual wetland ecosystem that supports a population of a rare plant. The <br />U.S. Forest Service designated the site as a Special Interest Botanic Area in 1982 and supports the <br />proposal for the site to be designated as one of Colorado's Natural Areas. <br /> <br />The Colorado Natural Areas Program, created the General Assembly in 1977, preserves the state's unique <br />landscapes that contain native plant communities, geologic formations, paleontological localities, or <br />delicate habitats for rare plants and wildlife. Natural areas may be on public or private land and are <br />designated through voluntary agreements with landowners. Currently, Colorado has 60 designated <br />Natural Areas in the state. <br /> <br />5 <br />
