<br />Draft <br />1/4/83 <br /> <br />A BILL FOR AN ACT <br /> <br />1. CONCERNING AUTHORIZATION By THE GENERAL ASSEMBLY TO DIVERT <br /> <br />2. GROUND WATER OUTSIDE THE STATE. <br /> <br />3. Be it enacted by the General Assembly of the State of Colorado: <br /> <br />4. <br /> <br />SECTION 1. 37-81-101(1), Colorado Revised Statutes <br /> <br />5. 1973, as amended, is amended to read: <br /> <br />6. <br /> <br />37-81-101. Unlawful to divert water for application <br /> <br />7. outside of the state. (1) The general assembly hereby finds and <br /> <br /> <br />8. declares that the location and availability of water in this <br /> <br />9. state varies greatly from place to place and that such <br /> <br />10. variation precludes the reasonable application of general law <br /> <br />11. to situations and regions of such diversity. THE GENERAL <br /> <br />14. ASSEMBLY FURTHER FINDS THAT DORING SOME YEARS THERE ARE WATER <br /> <br />15. SHORTAGES IN DIFFERENT AREAS OF THE STATE AND THAT THESE <br /> <br />16. SHORTAGES MAY CAUSE EXTREME PROBLEMS IN MEETING THE WATER <br /> <br />17. DELIVERIES REQUIRED 8Y INTERSTATE COMPACTS MEETING THE WATER <br /> <br />18. NEEDS OF THE CITIZENS OF THE STATE. AS A CONSEQUENCE, THERE IS A <br /> <br />19. CLEAR AND PRESENT NEED TO CONSERVE AND PRESERVE THE WATER SUPPLY <br /> <br />20. 01" THE STATE. ACCordingly, the general assembly hereby <br /> <br />21. determines that, for the purpose of aiding and preserving unto <br /> <br />22. the state of Colorado and all its citizens the use of all the <br /> <br />23. GROUND WATERS AND waters of the springs, lakes, ponds, creeks, <br /> <br />24. rivers, streams, and watercourses of this state, which waters do <br /> <br />25. not increase with the growth of population and which are <br /> <br />176 <br />ov/st <br />
