The:1949_.Appropr'iationAc_t, _(Pub-lic'- Lllw,8U-), 80th Congress, 2d Session, <br />provided tha.t "no part of this appropriation may be used for surveys, designs, or con- <br />struction of the Glendo Project, WVoming, or anw feature thereof to a greRter capacity <br />or for other purposes than set forth in Senate Document No. 191, 78th Congress, 2d 'I <br />Session, without the specific authorization of the Congress". The 1950 Appropriation <br />Act (Public Law 350) 81st Congress, 1st Session, provided that "in order to promote , <br />agreement among the states of Nebraska, Wyoming-, and Colorado, and to avoid any possible <br />alteration of existing vested rights, no part of this or of any prior appropriation <br />shall be used for construction or for further co~itment for construction of the Glendo <br />Unit or any feature thereof, until a definite plan report thereon has been completed, <br />reviewed by the States of Nebraska, Wyoming, and Colorado, and approved by the Congress." <br />A similar provision was contained in the 1951 Appropriation Act (Public Law 759) 81st <br />Congress, 2d Session. <br /> <br />"5. Authority to make this report and supporting documents is provided by virtue <br />.of these expressions of the Congress and the Federal Reclamation Laws' (Act of June 17,' <br />1902, 32 Stat. 388, and Acts amendatory thereof or supplementary thereto)." (PP.1-2 <br />of Regional Director's .-letter.)" . <br /> <br />Mr. Breitenstein read certain other excerpts from the above-mentioned planning <br />report of Region 7, and also read from his reports on two meetings which he and R. M.. <br />Gildersleeve, Chief Engineer of the Board, had attended on the Glendo matter. 'These <br />letters, one dated March 2, 1950,and the other May 26, 1951, were ordered inserted in <br />the minutes by the B card and are as follows: <br /> <br />"Ji':AN S. Stone, Director <br />Colorado Water Conservation Board <br />212 State Office Building <br />Denver, Colorado- <br /> <br />Dear Sir: <br /> <br />Mr. Gildersleeve and I attended the meeting I1eld today in the office of Avery <br />Batson, Director of Region 7, Bureau of Reclamation, for the purpose of discussing <br />the Glendo Project and the Bureau I s comprehensive study of the North Pla tte Basin. <br />Representatives of the States of Nebraska and Wyoming were also present. <br /> <br />Mr. Batson stated that the present thinking of his office was to the effect that <br />in the report on the Glendo Project now scheduled for comp:etion about July 1, the I <br />Bureau would recommend operation of Glendo Reservoir under its Plan 9 which contemplates <br />no irrigation benefits. It is the idea of the Bureau that Glendo may be operated under <br />Plan 9 in full conformity with the decree of the United States Supreme Court in the <br />North Platte Case. When called upon, I s~~ted that in all probability Colorado would <br />take no~position in regare to Glendo which might be deemed a waiver on the part of <br />Colorado to secure a modification of the North Platte decree under the provisions of <br />Article XIII (a) and (b) thereof. Mr. Bishop took the same position on behalf of Wyoming. <br />Nebraska would not make any definite commitment. There seems to be a fear on the part <br />
