<br />" <br />" - <br /> <br />Review of Administrative Record <br /> <br />The administrative record, including public written comments, all staff written comments <br />and all other written materials to be considered by the CWCB in this rulemaking will be <br />available for inspection at the CWCB office during normal business hours (8:00 a.m, - 5:00 p,m,) <br />May 26,2004 through July 20,2004, Copies are available upon request from the CWCB for a <br />fee of 25 cents per page, <br /> <br />HEARING PROCEDURE <br /> <br />The CWCB will not apply the rules of evidence or civil procedure. No member of the <br />public or CWCB Staff shall have the right to cross examine any person speaking at the hearing, <br />CWCB members may ask questions of any person appearing before them, At the end of all <br />public comment, the CWCB may allow members of the public to ask questions of staff or the <br />CWCB, <br /> <br />The chair ofthe CWCB may stop any Scheduled Oral Presentation or General Public <br />Comment ifthe person speaking has exceeded his/her allotted time. No exhibits, maps, <br />demonstrative exhibits or physical evidence may be presented in the oral summary unless such <br />material was attached to the participant's written comments. Once written comments are <br />submitted to the CWCB, the material becomes part ofthe Administrative Record and the <br />property of the CWCB and will not be returned to the person offering the material. <br /> <br />Subject to section 24-4-103, C.R.S" the Board may modify the proposed revised Rules <br />prior to promulgating final revised Rules, <br /> <br />DESCRIPTION OF THE SUBJECTS AND ISSUES INVOLVED <br /> <br />Under the proposed amendments to the Rules, current Rule 6g, will be deleted in its entirety and <br />replaced with the following: <br /> <br />6g, Temporary Acquisitions. The Board may acquire water for instream flow use <br />for a period not to exceed 120 days in any basin or county in which the governor has <br />declared a drought emergency or in which any other emergency is declared, in <br />accordance with the procedures set forth in section 37-83-105, C.R,S. (2003). <br /> <br />Rule 6i, will be revised to read as follows, with additions underlined: <br /> <br />6i. Public Input on Proposed Acquisitions, The Board shall follow the public review process <br />in Rules 11 a, - 11 c, when acquiring water, water rights or interests in water, except as provided <br />in Rule 6g, above and except as provided below. <br /> <br />Page 3 <br />
