<br />(4) <br /> <br />Director decides to accept the loan but the division engineer denies <br />the loan, the loan shall be deemed denied. <br /> <br />.@L(B) For temporary acquisitions on reaches of stream on '.vhich <br />the Board has a decreed instream flow '.vater right and the amOlmt <br />of water to he aeqHired eJweeds the decreed amoHRt, the Board <br />shall determine whether the amoUFIt of water to be acquired for <br />temporary instream flow use above the decreed amount is <br />approjlriate to preserve or impreve the natHral environment to a <br />reasonable degree. <br /> <br />(3)For temporary acqHisitiolls on reaches of stream on which the Board <br />has a decreed instream flew water right, the Boar-d hereby <br />delegates authority to the C'NCB Director to acqHire '.vater, y;ater <br />rights, or interests in water for instream flow \lse up to the decreed <br />amolll1t in accordance with the proeeaures set forth in section 37 <br />83 105 and to talee any administrative action neeessary to pllt the <br />acquired water to instream floY/llse. The pllrpose of this <br />dolegation is to allow a timely response to offers of water, water <br />rights or interests in water to meet emergency needs, <br /> <br />(4)(5) At the first regular or special Board meeting after the Director <br />accepts an offer of water, water rights or interests in water for <br />temporary instream flow use, the Board shall review the decision, <br />including the determination that the loan will preserve or improve <br />the environment to a reasonable degree, and shall vote either to <br />ratify or overturn the Director's decision. <br /> <br />(b) At the first regular or special Board meeting after the <br />Director reiects an offer of water that the division engineer has <br />approved, the Director shall explain the reasons for the rei ection <br />onhe loan, and the Board shall vote either to ratifv or overturn <br />the Director's decision. <br /> <br />2 <br />
