<br />~4t .VJ <br /> <br />Trout Unlimited's Proposed Changes to Rule 6g of the Colorado Water <br />Conservation Board's <br />"RULES CONCERNING THE COLORADO INSTREAM FLOW AND <br />NATURAL LAKE LEVEL PROGRAM" <br />Adopted on March 24, 2003 <br /> <br />6g, Temporary Acquisitions, The Board may acquire water for instream flow <br />use for a period not to exceed 120 days in any basin or county in which <br />the governor has declared a drought emergency or in which any other <br />emergency is declared, in accordance with-the proeedllres set forth iu <br />section 37 -83-105, C.R.S, (2003). <br /> <br />(1) The Board hereby delegates to the CWCB Director the authority to <br />accept or reiect a loan of water for temporary instream flow use <br />and to take anv administrative action necessary to put the acquired <br />water to such use, The purpose of this delegation is to allow a <br />timely response to offers of water, water rights or interests in water <br />to meet emergency needs, <br /> <br />81(2) Within seven working days of receiving an offer of water for <br />temporary instream flow use, staff will provide a preliminary <br />response to the proponent. If the preliminary response is positive, <br />at the time the response is given staff and if appropriate,shall-will <br />coordinate with the proponent on preparing and submitting to the <br />State and Division Engineers the neeessar)' documentation-feF <br />submittal to the State aRd Division Engineers required by section <br />37-83-105(2)(a)(I) and (2)(b)(I), C.R,S. (2003) and omay also assist <br />the proponent in providing the public notice required by section <br />37-83-105(2)(b )(lI). <br /> <br />- <br />.., <br /> <br />t.6j(3) fat-For temporary acquisitions on reaches of stream on which <br />the Board does not have a decreed instream flow water right or on <br />. reaches of stream on which the Board has a decreed instream flow <br />water right and the amount of water to be acquired exceeds the <br />decreed amount" the Director Board shall determine whether the <br />amount of water to be acquired for temporary instream flow use is <br />appropriate to preserve or improve the natural environment to a <br />reasonable degree. In making this determination, the Director mav <br />consult with anv governmental agencv, including the Colorado <br />Division of Wildlife, and with anv interested members of the <br />public, <br /> <br />(4) The Director must make a final decision on whether to accept or <br />reiect a proposed loan of water for temporarv instream flow uses <br />within the time within which the division engineer must approve or <br />denv the proposed loan under section 37-83-1 05(2)(b)(VII), lfthe <br />
