Instream Flow Program - Ratification of Stipulation - ISF Appropriations <br />Tape I, Start/Stop: 5509 - 5750 <br />Tape 2, Start/Stop: 3770 - 3820 <br />Action: The initial discussion of this case was tabled until Patricia Wells could arrive, due to <br />a needed recusal from the case by Allen Davey. When the case was <br />discussed, a motion was made by Patricia Wells that the Board ratify the <br />proposed stipulation in this case. The motion was seconded by Ray Werner, <br />and approved unanimously (6-0). <br /> <br />Ila. Executive Session - Background Briefings and Public Comment <br />Tape I, Start/Stop: 5786 - 6200 <br />Tape 2, Start/Stop: 0001 - 0855 <br />Action: Patricia Wells recused herself from the Vasquez Creek case, but indicated that she <br />will participate in the Forest Service cases. Allen Davey recused himself <br />from the San Luis issues except for any general discussion. David Harrison <br />recused himself from item 5, but will participate in general discussion in <br />items 2, 3 and 7. A motion was made by David Smith that the Board go into <br />executive session. The motion was seconded by Patricia Wells and approved <br />unanimously (7-0). <br /> <br />lib. Executive Session - Report from Executive Session <br />Tape 2, Start/Stop: 0855 - 0926 <br />Tape 2, Start/Stop: 3680 - 3753 <br />Action: Patricia Wells made a motion to approve the stipulation in Case No. 5-92CW286. <br />The motion was seconded by Allen Davey and approved unanimously (7-0). <br />In the Snowmass Water and Sand Case, (ll(a)(xii)), a motion was made by <br />David Harrison to ratify the intervention and the position taken by the <br />Attorney General's Office on behalf of the Board, with the principle purpose <br />of the motion being to continue to make it clear that the exclusive authority <br />for protection and enforcement of the State's instream flow water rights is <br />with the Water Conservation Board. The motion was seconded by David <br />Smith and approved unanimously (7-0). <br /> <br />12a.
