"I can tell you as far as the Denver vTater
Department is concerned, they couldn't get off
the hook. Our contract documents don't permit
it. ,'Ie learned a great deal about how to draw
contract documents from the United States of
America, particularly the Public Works Adminis-
tration. We have had contractors leave over
$1 million on the table but they walked in like
men and said 'We'll do our job and we'll give
you a whale of a job. ,'Te are sorry we didn't
bid a little more but you are going to get a
good job any way.'.

I would think it would be within the
province and the discretion of this Board to
adopt a measure asking that the bid be given to
the low bidder in each case unless the Attorney
General of the United States rules that this
cannot be done. I don't believe the government
contracts are this loosely drawn. I used a lot
of their real good tough provisions in drawing
those the Water Board uses and I think they are
real good. I think the government contracts are
sound enough that when a man makes a bid he's
got to stick to it."

motion is in order. I'm sure Mr. Dominy feels
as badly as I do and I'm going to have a crusade
of my own just to see how I can do."

"It has not yet been revealed as to whether
or not these contractors forfeit their bonds.
This was a substantial amount of money. If
they are required to forfeit their bid bonds,
this was a very substantial amount of money
in both cases that will partially compensate
the government for the dif;erences in the con-
tracts."

"The contractor is liable for the difference
even if the bond doesn't cover it."
