<br />. <br /> <br />Agreement <br />Concerning State Cost-Sharing Pursuant to the <br />Upper Colorado River and San Juan River Endangered Fish Recovery Act of 1998 <br /> <br />1. On behalf of the states of Colorado, New Mexico, Utah and Wyoming we <br />hereby agree that the cost associated with implementing the provisions of the Upper <br />Colorado River and San Juan River Endangered Fish Recovery Act of 1998, as <br />introduced, need to be shared by the states and that the states' share should be aHocated <br />as provided below. <br /> <br />2. Section 4(c)(i) of the Act states that the Secretary of the Interior, acting through <br />the Bureau of Reclamation, may enter into agreements with the Upper Division states, <br />political subdivisions or organizations within the Upper Division states which <br />contribute to the payment of capital project costs. The non-Federal contribution <br />aHocated to the states shaH not exceed $17 million. <br /> <br />3. The $17 million shaH be apportioned among the states based on their anticipated <br />depletions of Colorado River and San Juan River water through the year 2020. The <br />funds shaH also be aHocated proportionately between the two programs based on total <br />funding levels for each program. As a result, the states pledge to obtain the foHowing <br />funds for the programs: <br /> <br />. <br /> <br />. Colorado shaH provide $9.00 million (52.9 percent). <br />. New Mexico shaH provide $2.75 million (16.2 percent). <br />. Utah shaH provide $3.55 million (20.9 percent). <br />. Wyoming shaH provide $1.7 million (10 percent). <br /> <br />4. To the extent practical, funds provided by a state will be expended within that <br />state. <br /> <br />5. State funding provided for capital projects within the Upper Colorado River <br />Recovery Implementation Plan shaH be provided in accordance with agreements to be <br />developed by the Management Committees and approved by the Implementation <br />Committees of the recovery program. <br /> <br />6. State funding provided for capital projects within the San Juan River Recovery <br />Implementation Plan shaH be provided in accordance with agreements to be developed <br />by the Management Committees and approved by the Implementation Committees of <br />the recovery program. <br /> <br />7. This agreement shaH not bind the states or the signatories of this letter. This <br />letter indicates that each state shaH make a good faith effort to obtain the indicated <br />funding. The funds that may be provided to the recovery programs shaH be subject to <br />appropriations by the state legislature from each state. <br /> <br />. <br />
