<br />~tr. Kuiper: May I make one more comment? I agree with Larry that the <br />surface water rights are controlled by the courts, no question about <br />that. Where did that surface water come from is very definitely <br />important to this. Because of our compact with Kansas and Nebraska, we <br />are getting into a ticklish situation with these two states. We are I' <br />going to have to re-analyze the virgin flow and make a change of the <br />virgin flows of these rivers before we start computing the allocations <br />between Colorado, Kansas and Nebraska. So far, we have not taken into <br />consideration the contribution the Ogallala formation makes to these <br />rivers and we hope to do that. But if we get into this kind of a field, <br />then I think it deserves a pretty careful lo~{. <br /> <br />Mr. Stapleton: Sam, what do you have to say about this eastern slope <br />water? <br /> <br />ftr. ~mvnes: I think it is only appropriate that I make the motion that <br />the attorney make the filing. <br /> <br />ftr.
