~tr. Kuiper: May I make one more comment? I agree with Larry that the
surface water rights are controlled by the courts, no question about
that. Where did that surface water come from is very definitely
important to this. Because of our compact with Kansas and Nebraska, we
are getting into a ticklish situation with these two states. We are I'
going to have to re-analyze the virgin flow and make a change of the
virgin flows of these rivers before we start computing the allocations
between Colorado, Kansas and Nebraska. So far, we have not taken into
consideration the contribution the Ogallala formation makes to these
rivers and we hope to do that. But if we get into this kind of a field,
then I think it deserves a pretty careful lo~{.

Mr. Stapleton: Sam, what do you have to say about this eastern slope
water?

ftr. ~mvnes: I think it is only appropriate that I make the motion that
the attorney make the filing.

ftr. Stapleton: It has been moved. Is there a second?

Mr. Pickrel: I'll second it.

Mr. Stapleton: It has been seconded by Hugh. Any further discussion?

Mr. Kuiper: What was the motion?

Mr. Maynes: Whatever the Chairman said.

Mr. Stapleton: It is a motion that the attorney for the board be
directed to obtain the necessary stream flow rights as set forth in
the memorandum. (See Appendix D).

It has been moved and seconded. Any further discussion? All those in
favor signify by saying "aye" - opposed "no." Mr. Kuiper votes no.
The motion is carried. Would you like to state the grounds for your
motion in ten minutes or less?

ptr. Moses: Let me assure
copy of the application.
of opposition, it will be

~tr. Kuiper that I
If the Commission
appropriate.

will furnish him with a
wants to file a statement

1

Mr. Kuiper: I have already given you the grounds for the motion. I
think we need some input from the Colorado Groundwater Commission.

~Ir. Stapleton: Let's now turn to the attorney I s report, dr. i,ioses.

-36-
