<br />I <br /> <br />I <br /> <br />Mr. Stapleton: Thank you, Mr. Kochman. What is the recommendation of <br />the staff? <br /> <br />Mr. Sparks: Mr. Chairman, we recommend that the recommendations of the <br />Division of Wildlife be approved and that we be directed to initiate <br />the proper action in the water court to obtain an adjudication. <br /> <br />What intrigues us mostly is the attitude of the landowners in that <br />area. We found that they were wholeheartedly behind this proposal and <br />that they also wished the environment on their lands to be protected. <br />I might say this is a somewhat unique attitude on the part of the land- <br />owners. It is a very unique area. The staff recommends that the <br />board approve this request. <br /> <br />~tr. Stapleton: Mr. Kuiper. <br /> <br />i1r. Kuiper: Yes, I have a question. Did you consult with the COlorado <br />Ground Water Commission on these recommended minimum flows? <br /> <br />~tr. Kochman: We didn't. Whether Mr. Callahan had previously for the <br />particular landowners, I don't know. But we didn't. <br /> <br />Mr. Scharpella: I talked to him Wednesday morning and he said that he <br />had talked to the landowners and that they have no objections. <br /> <br />~tr. Kuiper: ~tr. Callahan is not on the board. I am executive director <br />of the board and I never heard of it before. <br /> <br />Mr. Scharpella: But Mr. Callahan, you have to give the gentleman <br />credit. He did a lot of long-range planning prior to the recommendation <br />to find out if there were any objections. They would try to correct <br />them before they ever brought it up to the State. <br /> <br />~lr. Kuiper: Has the Arikaree Groundwater Management District been <br />consulted? <br /> <br />~lr. Scharpella: I believe that they have been. <br /> <br />~tr.'Kuiper: I am not aware of that either. <br /> <br />Mr. Vandemoer: It is down in my area near Sterling. Lester Winfield <br />is the president of the ArDcaree Groundwater District. He said he <br />would not object to the decision of this board. But they were worried <br />about this sort of approach because it looked as if they didn't have <br /> <br />-33- <br />
