vOlved has already been included in all the
planning that we have done in the Colorado River
Basin. It has been accounted for; that is, the
consumptive use of that water has already been
accounted for and does not effect, in our opinion,
any project which this Board has under contempla-
tion.

The matter of the transfer proceedings is
strictly a matter up to the District Court in
that area. It is not a matter over which this
Board has any concern or jurisdiction. That being
the case, we are not able to come up with any
objection as far as the policy making authority
of this Board is concerned in connection with
this request. We simply regard it as being out-
side of the province of this Board on the facts
as presented in this memorandum. We have tried
to point out that we are limiting Our opinion
strictly to the facts of this case."

"If that be true, Larry, why do you say at
the bottom here 'I therefore recommend that the
Colorado Water Conservation Board approve this
proposal.'? Why should we have anything to do
with it?"

"A request was made that this be submitted
to this Board. Now, as a little history as, to
how this request came about, you will recall
that there was a contract - a proposed contract -
entered into between Region 7 of the Bureau of
Reclamation and a Mr. John Elliott involving the.
transportation of water from the Yampa River into
the North Park, then back into the Colorado and
then through the facilities of the Colorado-Big
Thompson Project into the platte River drainage.
Our first notice of those negotiations came from
Washington after a proposed contract had been
submitted to Washington. At that time it was
called to my attention by Congressman Aspinall
while I was acting as Director of Natural
