Lakewood shall secure <br />any corps approval of the Fox Hollow at Lakewood Golf Course <br />as may be required by its agreement and lease with the corps. <br /> <br />. <br /> <br />13. Board's Disclaimer of Resoonsibilitv for Golf Course. <br />The Board has no responsibility for the flood control <br />operation of Mt. Carbon Dam, or for the design, location, <br />construction, and operation of Fox Hollow at Lakewood Golf <br />Course, or for the withdrawal and use of the Lakewood Water, <br />and disclaims any liability therefor. Lakewood has full <br />responsibility for the design, location, construction and <br />operation of the Fox Hollow at Lakewood Golf Course, and for <br />the withdrawal and use of the Lakewood Water. This Agreement <br />shall not be deemed an assumption by the Board of any such <br />responsibility nor of any liability for damages to the golf <br />course or other property or personal injuries which could <br />arise from such responsibility, or from Lakewood's failure to <br />design, construct, and maintain the golf course so that the <br />Bear Creek Channel can safely and adequately pass the flood <br />flows arising from the authorized operation of Bear Creek Lake <br />Dam. <br /> <br />. <br /> <br />-9- <br />
