Maintenance of stream Channel. upon the commencement <br />of storage of the Lakewood Water in Bear Creek Lake pursuant <br />to Paragraphs 2 and 3 of this Agreement, and to the extent of <br />Lakewood's rights under its lease of Bear Creek Lake Park from <br />the Corps, Lakewood agrees to maintain .the stream channel of <br />Bear Creek from immediately below Bear Creek Dam to the point <br />at which the channel exits the eastern boundary of Bear Creek <br />Lake Park, which point more specifically bears S 75. W a <br />distance of 500 feet, more or less, from the center corner of <br />Section 33, T. 4 S., R. 69 W. of the 6th P.M. The following <br />will be considered as minimum action required by Lakewood to <br />maintain this segment of the stream channel: <br /> <br />. <br /> <br />a. <br /> <br />Prevent wasting or dumping of materials in the <br /> <br />channel; <br /> <br />b. Ensure that accumulations of debris around <br />structures in the channel such as bridges and weirs will be <br />removed promptly following a flood; and <br /> <br />c. Control all alterations of and encroachments <br />upon the "revised floodplain" as delineated in the two-page <br />floodplain analysis performed by Muller Engineering and set <br />forth in its letter of December 7, 1990, attached hereto as <br />Exhibit A, except for necessary construction in the floodway <br /> <br />. <br /> <br />-7- <br />
