I do not have <br />formal approval of the Agreement from the board of county <br />commissioners at this time, but I wanted to send you this draft <br />as soon as possible to expedite the process. <br /> <br />As we discussed on the telephone, Arapahoe currently plans <br />to operate the Union Park Reservoir Project so as to maintain <br />minimum and maximum flows on Lottis Creek below the reservoir. <br />Therefore, the segment on Lottis Creek between Union Park <br />Reservoir and its confluence with the Taylor River will continue <br />to be accessible for public use to its current extent. I have <br />tried to address this situation fully in the Agreement. <br /> <br />In addition, please be advised only 4,400 feet of the Lottis <br />Creek segment within the Union Park Reservoir basin would be <br />inundated by the additional junior conditional water rights <br />applied for in Case Nos. 86CW226 and 88CW178. The majority of <br />that stream segment would be inundated by the conditional water <br />right decreed in Case No. 82CW340 which is senior to CWCB's <br />Lottis Creek minimum stream flow. However, as you can see from <br />the Agreement, Arapahoe agrees to mitigate for the full 3-1/2 <br />miles within the reservoir in order to make a good faith effort <br />to settle these cases. <br /> <br />arap178 \ letters \ s lals' <br />
