The project will be operated in such a manner that those <br />in Eastern Colorado using project water imported from the Colorado <br />River Basin for domestic purposes shall have preference over those <br />claiming or using water for any other' purpose. <br /> <br />13. The project is to be operated in such a manner as to secure <br />the greatest benefit from the use and re-use of imported project waters <br />wi thin project boundaries in the State of Colorado. <br /> <br />14. The benefits and rights of Western Colorado water users in <br />and to water stored in Green Mountain Reservoir, as described and de- <br />fined in Senate Document 80, Seventy-fifth Congress, First Session, <br />shall not be impaired or diminished by this project. <br /> <br />15. T he project, its operation, maintenance, >"and use shall be <br />subject to the provisions of the Upper Colorado River Basin. Compact of <br />October 11, 1948 (Public Law 37, 81st ~ongress, First Session), the <br />Colorado River Compact of November 24, 1922 (House Document 605, 67th <br />(;ongress, 4th sessionf, and the BoUlder Canyon Project. Act of December <br />21, 1928 (45 Stat. '1057-1064). In the event any curtailment of use of <br />Colorado River water in the State of Colorado is necessary to satisfy <br />the provisions of the Colorado River Compact or the Upper (;olorado River <br />Basin Compact, then the diversion of water for the benefit of Eastern <br />Colorado shall be curtailed in advance of any curtailment of use of <br />eolorado River water in Western Colorado. <br /> <br />16. The Secretary of the Interior shall at any time have tile <br />option to obtain or require the transfer to the United States of any am <br />all rights initiated or acqUired by the appropriation or use of water <br />through the works of the project in Eastern Colorado, 'except vested rights <br />to present appropriations; provided, however, that the title so taken <br />shall be subject to a beneficial use of such water as may be provided <br />in the p~ment contract or contracts. The rights to store water in <br />Aspen Reservoir to the extent of 28,000 acre-feet slJall be initiated, <br />acquired and held in the narne.of the United States for the replacement <br />of water diverted to Eastern Colorado and for use in Western Colorado. <br /> <br />1 <br /> <br />17. To assure project operation in conformity with the operating <br />principles heretofore stated, to provide a means for the collection and <br />interchange of information, and to provide a method for the continued <br />study of project operations to. the end that, if the stated operating <br />principles ~ be improved upon, recommendations for changes may be made <br />to the contracting parties, a commission shall be created in an appropri- <br />ate manner to be composed of one representative of the Eastern Colorado <br />eonservancy District, one representative of the Colorado River Water Con- <br />servation District, two representatives of the United States, and one <br />representative of the State of Colorado appointed by the Colorado Water <br />Conservation Board after consultation with the Colorado Game and Fish <br />:COmmission. The powers of such commission shall be limited to the <br />collection of data, the making of findings of fact, and the suggestion <br />of changes in operating principles. <br />
