Colorado: Despite the efforts of mediator Joseph Mazurek and the States, it has not been possible <br />to settle the remaining issues in the case at this time, The States, however, intend to continue to consider the <br />possibility of settlement, especially upon completion of the final expert reports and related discovery, Given <br />that there is nothing further to report regarding settlement, Special Master Arthur Littleworth has ordered <br />that trial resume on June 17 at 9:30 am in Pasadena, Califomia, The issues to be heard are: <br /> <br />(a) The recalculation of Kansas' damages for the period 1950-1994 in accordance with the <br />Supreme Court's Opinion of June 11,2001. <br /> <br />(b) Whether there have been depletions of usable Stateline flow, in violation of the Arkansas <br />River Compact, subsequent to the Special Master's Order of January 11, 1999 (depletions of <br />1995-1996), <br /> <br />(c) The determination of money damages for all depletions occurring after 1994, <br /> <br />(d) Whether the administration provisions established by Colorado are adequate to ensure present <br />and future compliance with its Compact obligations in regard to well pumping, <br /> <br />(e) Any other matters required for preparation of a [mal judgment, <br /> <br />Finally, the Special Master has requested another $100,000 from each state by July 15, 2002, Colorado <br />has expended in excess of$12 million dollars on this litigation to date, <br /> <br />Special Arkansas River Compact Administration Meeting: ARCA met in Garden City, Kansas on May <br />9-10 to discuss differences in the accounting of inflows into John Martin Reservoir and deliveries of water to <br />12 <br />
