It is staff's opinion that the 21 years of stream-flow data analyzed is representative of <br />average water-years. <br /> <br />Existing Water Right Information <br /> <br />Staff has analyzed the water rights tabulation and consulted with the Division Engineer's Office <br />(DEO) to identify any potential water availability problems. There are several decreed surface <br />diversions within the proposed lower instream flow reach. Currant Creek is not subject to calls <br />from the Arkansas River due to a dry segment of stream below the lower terminus of the <br />proposed instream flow segment; this results in a "Futile Call" on Currant Creek. Currant Creek <br />is then self-administered by the local water user based on an agreement between the water users. <br />Based on this analysis, staff recognizes that small portions of Currant Creek may experience <br />water shortages during the irrigation season. However, return flows accrue quickly to the stream <br />providing sufficient stream flows in the maj ority of the proposed lower instream flow reach to <br />preserve natural environment to a reasonable degree without limiting or foreclosing the exercise <br />of valid existing water rights, between the confluence with Thirtyone Mile Creek and the <br />confluence with Cottonwood Creek. <br /> <br />- 8 - <br />
