After hearing the statements <br />made during the rulemaking hearing, after considering exhibits 1 <br />through 214 in the administrative record, after considering the further <br />written materials submitted for Board consideration until 12:00 noon <br />on November 9, 1993, and after considering the statements made <br />today, I move the Board adopt' as its final rule the November 4, 1993 <br />draft rule with the following additions, deletions and modifications. 1) <br />the Board incorporates the Basis and Purpose statement by this <br />reference into section 2 of the rules 2) That the full text of the public <br />review process be removed from sections 5, 6, 8, 9, 10, and 11 and that <br />this material be combined and included in a new section. 3) that staff <br />make those nonsubstantive textural changes suggested by the public <br />that would add clarity to the final rules and regulations, specifically <br />referenced by the River District, and others as well and 4) the changes <br />proposed by the Board today. That we remove the language regarding <br />"unique, rare, irreplaceable environment from section 8 of the rules <br />and then we add the language and make the changes discussed in <br />section 4 concerning the definitions.
