Water Division 1 - Boulder and North Boulder <br />Creek ISF appropriations 10:45 - 10:50 a.m. <br />Tape 5 Start Stop 1737 - 1908 <br />Action: A motion was made by Tommy Thomson that the Board ratify the staff <br />recommendation that the Board make a finding that a natural <br />environment does exist on each stream, that the water will be made <br />available upon settlement of Case No. 1-90CW193 for each stream for <br />appropriation that the natural environment will be preserved by a <br />reasonable degree by the water available for the recommended <br />appropriations. That there is a natural environment that can be <br />preserved to a reasonable degree with the recommended water rights <br />granted and such natural environment can exist without material injury <br />to the water and that we appropriate based upon these determinations <br />the recommended instream flow water right on the streams listed, such <br />appropriations being for such waters as have been determined to be <br />required for minimum stream flows to preserve the natural <br />environment to a reasonable degree and direct the Attorney General's <br />Office to file the necessary water rights applications upon settlement <br />of Case No. 1-90CWI93. The motion was seconded by David Smith <br />and the motion passed unanimously (7-0). <br /> <br />David Harrison recused himself. Ken Salazar and Jim Lochhead were absent. <br /> <br />~ <br /> <br />o <br /> <br />. <br /> <br />16b. Water Division 4 - Beaver and Saltado 1:55 - p.m. <br />Tape 5, Start/Stop 4718 - 5186 . <br />Action: A motion was made by Jim Lochhead to determine pursuant to section <br />37-92-102(3), CRS, and based upon the recommendation of the BLM <br />and DOW, a review of the data and other information presented by <br />the staff and the staffs recommendations for instream flow <br />appropriations on the streams identified in the attached final Notice: <br />that; (a) a natural environment does exist on each stream; (b) water <br />is available in each stream for appropriation; (c) the natural <br />environment will be preserved to a reasonable degree by the water <br />available for the recommended appropriations; (d) there is a natural <br />environment that can be preserved to a reasonable degree with the <br />recommended water rights, if granted;. and (e) such natural <br />environment can exist without material injury to water rights. That <br />second that we appropriate, based on these determinations, the <br />recommended instream flow water rights on the streams listed in the <br />attached notices, said appropriations being for such waters as have <br />been determined to be required for minimum stream flows to preserve <br />the natural environment to a reasonable degree with the caveat the <br />Board's intent to accommodate the reformulation as part of our intent <br /> <br />Draft Minutes November 9 - 10, 1993 CWCB Meeting <br /> <br />18 <br /> <br />. <br />
