.'167

Mr. Beaty: "I would like to be sure that they comply
with the Colorado State laws."

Mr. Dille: "This .is a report of the Corps of Engineers
and a repayment will be made through the Bureau of 'Re-
clamation."

Mr. Powell: "The Corps will construct the project and
repayment will be made through the Bureau." .'

D~. Donnelly: "As you heard Mr. Gildersleeve's report,
I might add that Mr. Gildersleeve is well versed on
this project. He is well-founded, and that is a very
good analysis that he has brought to you. 1n.1948 we
went down to.-the District Engineer's office; I talked
to the engineer and we were able to wangle a copy of
the report. They were not allowed to give it out, so
we'were rather fortunate. We were thinking at the time
we were not being given credit for the flood damage.done
in that community in the last 50 years. This study has
been made in conjunction with the Army and the Bureau of
Reclamation. Trinidad really needs the project. It is
something that is vital to us."

Mr. Beaty: "I think this should be operated according to
state law. I understand that the Corps of Engineers.does not
always operate that way."

I

Col. Barnes: "I have heard no complaints among the people
themselves. We want someone to tell us what to do and
when to do it. We are charged with the construction of
the reservoir, but not with the operation. We are not
always sure what is legally right."

"

Mr. Beaty: "I would like to have a commitment from the
Corps of Engineers that they will comply with the State
Law.~'

Col. Barnes: "That is usually in the authorization, .and
also repeated in the appropriation act."

Mr. Bailey: "It is Mr. Beaty's suggestion that we should
operate under state law."

Mr. Kancilia: "This dam will not only be for the benefit
of flood control, but it will be beneficial for irrigation
and it means a great deal to southern Colorado."

Col. Barnes: "I have no objection to a statement saying
that we will operate according to state law."

Mr. Bailey: "Is there anyone here that has any objection
to the project?"

r

,
-
