Whether the granting of the easement will adversely affect Board functions or programs <br />directly or indirectly related to the proposed easement property. <br /> <br />E. Whether the granting of the easement is in the best interest of the Board and the State of <br />Colorado. <br /> <br />F. Whether there is a viable alternative route(s) for the easement on adjacent property. <br /> <br />G. Whether a party can be named and identified and who shall be responsible for rnaintaining <br />improvements such as: utility, underground pipe, etc. that are involved in the easement now <br />and in the future. <br /> <br />9. All easement documents shall be reviewed by the Attorney General's Office prior to the <br />execution of the Agreement by the Director. <br /> <br />10. No permanent structures such as buildings, storage facilities, or decks will be approved. <br />Facilities such as drainage structures, utilities, parks, tress, benches, trails, and other public <br />amenities will be reviewed on a case-by-case basis. <br /> <br />. <br /> <br />11. The CWCB may determine that the benefit to the State would be best served by a waiver of all or <br />part of the fees otherwise charged for an easement and upon making such findings may waive all <br />of part of such fees. <br /> <br />Other considerations <br /> <br />The CWCB may grant approval for temporary construction and access easements, which have <br />no permanent impact. The CWCB may consider other factors in reviewing easement requests. These <br />guidelines are not construed to require the CWCB to make findings when granting or denying <br />easements, or when determining the fee to be charged. <br /> <br />. <br />
